EB-5 IMMIGRANT INVESTOR PROGRAM

We combine practical knowledge of infrastructure financing and development with, high touch individual service to move projects forward and advance immigration.

Our approach

The EB-5 Immigrant Investor Program enacted by Congress in 1990 allows foreign investors to achieve legal U.S. residency as a result of specified financial investments in the U.S. The program has grown from more than 1,800 EB-5 visas issued in 2010 to the maximum of 10,000 visas this year. It is attracting billions of dollars of needed investment in a range of infrastructure and community development projects.

The U.S. Department of State reports more than 85% of EB-5 visas issued during fiscal year 2014 went to Chinese investors and their immediate family members. And that was a 30 percent increase over the previous year. With offices in China and Mandarin-speaking lawyers in the U.S. and Asia our team offers local resources with the requisite skills to collaborate  with Chinese investors on EB-5 projects.

EB-5 financed deals are complex. They involve a broad spectrum of legal disciplines such as:

  • debt finance
  • securities
  • real estate
  • immigration
  • tax

We negotiate and document all aspects of the EB-5 transaction, including preparation of private offering documents, operating agreements, partnership agreements, loan documents, intercreditor agreements and escrow agreements.

Who we work with

  • Real estate developers
  • Regional centers
  • Community development agencies
  • Individual investors
