Introduction
Bradley provides diverse IP protection to large companies and startups by strategically building comprehensive global IP portfolios to monetize and protect products and methods using utility patents, design patents, trademarks, and copyrights. He also helps his clients with litigation financing, patent litigation, licensing, patent mining workshops, and general counseling on IP matters.
My focus
My practice focuses on helping clients create and enforce monetizable IP using customized patent mining workshops that convene diverse, talented groups to expand conversations and increase innovation.
Monetization — PMP™
My monetization practice includes helping companies monetize their patent portfolio by generating revenue through use of their patents, typically using licensing agreements and/or litigation. I developed the PMP™ process to assist clients and businesses with this goal.
Through the streamlined and cost-effective PMP™ service, I provide consultation to my clients on their patent portfolios and shortlist the patents that potentially overlap with infringing products. I then identify the patents within this shortlist for additional investigation to determine which ones clients can license to the makers of products.
Patent Prosecution
My patent prosecution practice involves building and expanding global patent portfolios. I implement patent mining workshops across the globe to help clients generate new IP for monetization purposes. I manage a large team of diverse Nixon Peabody lawyers, and I leverage a global network of foreign associates that provides clients with a seamless and efficient global IP prosecution experience.
My practice covers a wide variety of technologies, including medical devices and medical implants, AR/VR devices, systems with integrated AI, fashion/clothing, systems for aiding sleep disordered breathing, healthcare management systems, photo management systems, software, fintech, gemstones, smart/IoT electronics, railway systems, wearable technology, beverage systems, dental systems, energy generation and storage systems, and toys, among others.
Litigation
My litigation experience includes managing a high stakes monetization campaign asserting multiple patents against multiple defendants, winning a high-stakes patent arbitration, and drafting complaints, motions, and supporting memoranda in Illinois state and federal courts. I have been instrumental in achieving beneficial settlements for several clients.
Representative experience
- Representing Almod Diamonds, owner of the Diamond International Trademark—one of the most recognized fine jewelry brands in the world, with retail locations throughout the Caribbean, Mexico, Florida, and Alaska—in global patent and trademark portfolio management and enforcement for its proprietary gemstone shapes and brands.
- Representing Cassey Ho, a world-renowned content creator, fashion design entrepreneur, and founder of the brands Blogilates and POPFLEX. Cassey creates and sells innovative clothing like skorts, dresses, leggings, and bras, including the viral Pirouette Skort in Lavender. We handle a variety of her IP matters, including design patent applications, trademarks, trade dress, and copyrights, among other legal and strategic services.
- Customized patent mining to lead the creation of a software portfolio designed to be monetized for one of the largest medical device manufacturers in the world.
- Provide digital health patent prosecution and IP counsel on behalf of Kolibree, a smart toothbrush licensed to Colgate that helps children and adults have better brushing habits.
- Represent MemoryWeb, LLC, which developed photo organization/display technology to help users sort, find, and view their photos, in various matters including patent enforcement campaigns, patent litigation and licensing discussions.
- Represent Baracoda Labs, a healthtech startup, to provide general IP counseling.
Looking ahead
Most companies in 2024 will try and incorporate AI into their products and miscalculate if their new solution is patentable.
