Introduction
Ben Rosborough is an associate in the Intellectual Property group, where he represents clients in intellectual property transactions and counseling matters. He focuses his practice on preparing and prosecuting foreign and domestic patent applications in the mechanical, electro-mechanical, electrical and software arts. My focus
My practice and experience spans a wide range of industries and technologies, including electromagnetic motors and generators, MRI imaging systems and methods, optical microscopy and fluorescence imaging systems, respiratory therapy devices, optical masks for wavelength sorting, optical antenna systems, augmented reality systems, neural networks, computer cooling systems and other computer hardware, OLED driver circuits, medical devices, optical temperature measurement systems, hardware for currency and coin processing/imaging systems, mass storage architectures, tools, pipetting systems, dental implants and eye therapy systems.
I assist in all aspects of domestic and global patent prosecution, including due diligence, drafting applications, office action responses, appeal practice, reissue and post-grant review proceedings and managing local counsel for foreign office actions. I also assist in drafting invalidity and non-infringement opinions and I provide support for various stages of litigation, including briefing on claim construction, infringement and validity issues.
Looking ahead
I believe that the USPTO’s recently-updated §101 guidance will provide new opportunities for companies and inventors to protect their inventions in software and related arts. Keeping abreast of how the updated guidance is implemented and applied by examiners will be of critical importance in the near future.
