/Representative experience
- Secured a unanimous verdict in favor of our aircraft company client after a three-week trial, in which the jury agreed that the client’s plane was safe and free from defect.
- Successfully litigated fraud claim in an expedited six-day bench trial in Delaware Chancery Court against defendant biotech company, with $49 million in damages and pre-judgment interest awarded to our pharmaceutical company client.
- Recovered over $2 million for a client in a three-week jury trial in the Eastern District of New York in connection with repair costs against a consultant and its subcontractor. The case was complex, involved numerous fact and expert witnesses, and multiple parties, and spanned over three weeks. The result was a unanimous win for the client, and it was featured in TopVerdict.com’s “Top 100 Verdicts in New York.”
- Obtained a favorable verdict that secured our client’s ownership in a hotly contested trademark.
- Won successful jury verdict for a franchisor, after a six-day jury trial in state court against three former franchisees regarding the violation of non-compete agreements. The jury returned a verdict in favor of our clients on its breach of contract claims and against the defendant franchisees on all counterclaims.
- Judicial victory for client, the owner of a commercial building in Boston’s Back Bay, in a dispute with a commercial tenant. The trial in December 2020 was only the second virtual trial to be held in the Business Litigation Session of the Massachusetts Superior Court. The court also awarded our client attorneys’ fees as a prevailing party.
- Won a bench trial for the author of the iconic board game, The Game of Life, on the issue of copyright ownership, which was affirmed unanimously on appeal by the First Circuit.
- Secured a precedent-setting Bench trial decision for our client in the Central District of California in 2019. We won the case in the lower court after a full trial on the merits by convincing the judge (who wrote a lengthy decision in our favor) that our adversary’s allegations were unfounded, there was no evidence to support them, and that the court’s prior, pre-trial decisions (in our favor) should control.
- Commercial design/build contractor in a six-day-long civil rights/employment trial in the Northern District of New York. Plaintiff brought an action for hostile work environment and retaliatory discharge under both Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act against our client (her former employer). All causes of action were dismissed on summary judgment except the retaliation claims. The jury returned a unanimous verdict in favor of our client. Affirmed by Second Circuit.
- In a dispute running for 13 years, and the subject of an arbitration, two trials, and two appeals, we successfully represented Bourbon Marble, Inc., in recovering more than $4.3 million in damages, litigation fees, and costs in a breach of contract action against Pepper Construction Company.
