Kevin Shea focuses his practice on complex commercial litigation, with a focus on healthcare litigation and class action defense. He represents private and publicly traded companies and their executives in federal and state courts and arbitration proceedings throughout the country.

With more than twenty years of experience, I help my clients resolve disputes through early pre-suit settlements or aggressive litigation through trial and appeal. My practice focuses on:
Healthcare Litigation and Counseling
I defend publicly traded healthcare companies in litigation matters, arbitrations, and regulatory proceedings throughout the country. I currently represent a Fortune 10 healthcare company in numerous arbitration proceedings involving its retail pharmacy network. I am also representing that same company in several litigation cases challenging its business practices. I represented a medical device maker in contested litigation concerning alleged defects in patient monitoring equipment. I have also recently advised a laboratory testing company in connection with a proposed consumer offering.
Class Action Defense
I defend clients against class actions and aggregate litigation matters in federal and state courts. I recently represented a large retail pharmacy chain in a consumer class action lawsuit related to its prescription drug program. I also recently represented two major domestic airline carriers in class actions involving statutory claims under foreign regulations and obtained dismissal of the plaintiffs’ complaints based on jurisdictional grounds. I assisted a large automaker in the defense of a consumer class action relating to alleged tire defects.
Complex Commercial Litigation
I assist clients in a variety of complex commercial litigation matters involving fraud, statutory claims, breach of contract, breach of fiduciary duty, and other business disputes. I recently represented an Italy-based advertising agency in litigation against a large computer manufacturer for breach of contract relating to advertising services. The case involved complex international procedural laws and discovery throughout the United States and in Europe. I have also advised insurers on issues of policy coverage under commercial general liability policies and have represented them in insurance coverage litigation.
Looking ahead
I see increased risk for domestic corporations operating globally from lawsuits in the United States involving claims arising under foreign law. These can include statutory claims enacted by the European Union. Plaintiffs and their counsel will continue to assert such claims here to subject corporate defendants to the associated risk and cost of United States class action procedural law and discovery rules.
