Stacy Boven is a privacy and technology attorney who enjoys advising clients on protecting their information assets and litigating high-stakes commercial disputes. Stacy leads the firm's Tracking Technology Litigation team.
I help businesses protect their data, innovation, and intellectual property. As a results-oriented litigator and trusted advisor, I focus on maximizing value for my clients by implementing risk management strategies that are business-focused. With over 10 years’ experience navigating complex commercial matters for both defendants and plaintiffs, I built my practice by managing arduous multiparty disputes and streamlining the litigation, trial, and settlement processes.
From emerging startups to multinational public companies, I advise clients on risk management strategies, implementation of data usage and privacy policies, invention assignments, as well as non-disclosure, confidentiality, licensing, and arbitration agreements.
When litigation becomes necessary, I rely on my decade of experience as a complex commercial litigator to find an efficient resolution. I represent clients across a range of industries in intellectual property matters, including California Invasion of Privacy Act (CIPA), tracking technology litigation, trade secret misappropriation, trademark and copyright infringement, and licensing disputes.
My experience litigating complex business disputes spans the range of consumer class action defense, commercial contracts, corporate and fiduciary liability, partnership and shareholder issues, and business separations. Understanding the tension between the increasing demand for transparency and the value of privacy, I’ve assisted clients with trade secrets, non-competition agreements, tracking technology litigation, as well as Freedom of Information Act (FOIA) requests and California’s Public Records Act matters as well. My experience ranges across a variety of industries, including gig economy technologies, social media, transportation, healthcare, consumer products, real estate, beverage and alcohol, higher education, solar, and green technologies.
I represent corporate clients in high-stakes federal and state appellate matters. I have prosecuted and defended against writ petitions and appeals across an array of subject matters, including insurance, transportation, immigration, and consumer product.
As our reliance on data and technology grows, protecting our information assets is more important than ever before. Tracking technology litigation is growing in popularity, putting any company that uses standard tracking or data analytics tools at risk. The best offense starts with a good defense. In our tech-centered world, this means regularly auditing data usage practices and employing the comprehensive policies and agreements that prioritize transparency and consent.
This article covers three digital privacy class action lawsuits against LinkedIn contending that the company illegally intercepted users’ sensitive healthcare information to use targeted advertising. San Francisco Privacy & Technology counsel Stacy Boven is quoted in the coverage, discussing how tracking technology litigation, including wiretapping claims under the California Invasion of Privacy Act (CIPA), can affect basically any company with a public-facing website. Stacy also notes that this litigation is impacting a wide range of industries, especially those that benefit most from leveraging data for client management and advertising purposes.
