Maggie Horstman represents clients on trademark protection and enforcement matters and assists clients in resolving trademark disputes.
My focus
My practice is focused on assisting clients in trademark disputes before the U.S. Trademark Trial and Appeal Board and District Courts, developing and executing enforcement strategies, and advising on all aspects of trademark prosecution. I frequently advise on strategies to address third party infringing conduct and conflicting references at the USPTO, draft and negotiate settlement and licensing agreements, and provide analysis on trademark clearance and registration.
Looking ahead
Increased consumer awareness and the rise of self-care culture has led to notable growth in the health and beauty industries. Technological advancements, including noninvasive cosmetic treatments and devices for at-home use, are increasing in popularity and consumers are progressively demanding new and effective beauty products and services. Further, social media marketing has become the norm, allowing consumers to easily share a high volume of information. Now more than ever, health and beauty brands need to take precautions when choosing a brand, stay vigilant in the protection and enforcement of trademark rights, and ensure the effectiveness of agreements to safeguard their intellectual property rights and reputation.
