Healthcare Transactions
I advise healthcare organizations on mergers and acquisitions, joint ventures, and other corporate transactions. My clients include private equity firms, nonprofit and for-profit health systems, academic medical centers, community hospitals, and post-acute and sub-acute providers such as home health and hospice providers, therapy providers, behavioral health providers, and senior living facilities.
Dental and Veterinary Transactions
I also advise dental and veterinary organizations on mergers and acquisitions. My clients include both private equity firms and strategic providers.
Regulatory Compliance
I provide regulatory guidance to hospitals, health systems, and physician clients on a wide range of regulatory matters, such as physician contracting, Stark Law and the Anti-Kickback Statute (AKS) compliance, corporate practice of medicine compliance, licensure and accreditation, and Medicare and Medicaid enrollment. In addition, I assist clients with identifying and addressing physician compensation arrangements that potentially implicate the Stark law, including self-disclosure of such arrangements to the Department of Justice (DOJ), the Office of the Inspector General (OIG), and Centers for Medicare & Medicaid Services (CMS).
Looking ahead
I expect that deal volume will increase as private equity firms, healthcare providers, and companies seek to capitalize on growth opportunities in the market and pursue operational goals to allow them to achieve value-based care benchmarks. The increased prevalence of state-level notification laws will cause potential buyers to need to be more creative, but the Nixon Peabody Healthcare team is constantly monitoring these developments and is ready to assist its clients in continuing to aggressively pursue opportunities across all healthcare industries.
