Introduction
Jennette W. Psihoules counsels clients on all aspects of trademark and copyright law and provides a full range of intellectual property services, including prosecution and protection, enforcement, litigation, licensing, and the commercialization of IP assets.
My focus
I focus my practice on trademark and copyright protection and enforcement, as well as IP litigation and licensing. I routinely advise clients on trademark selection, clearance, and prosecution, as well as copyright protection and registration. I have extensive experience managing large-scale domestic and international IP portfolios and developing and administering effective IP enforcement programs for clients across a variety of industries. I also have significant experience in IP litigation having represented clients in actions in federal court and before the Trademark Trial and Appeal Board (TTAB). Based on my previous experience working in-house with a major media company, I also have a background in drafting and negotiating complex IP licenses and other IP and entertainment-related agreements. My well-rounded knowledge and experience in intellectual property law enable me to advise clients on how to best protect and capitalize on their IP rights.
Representative experience
- Manage domestic and international trademark portfolios and enforcement programs for large video game company, iconic golf course, luxury bed and mattress company, brand development and marketing company, and medical technology company, among others
- Advise and counsel on all aspects of copyright protection and enforcement, including registration and requests for reconsideration before the U.S. Copyright Office
- Represent clients before the Trademark Trial and Appeal Board
- Represent luxury bed and mattress company in a trademark dispute in federal district court
- Represent major video game company in a trademark and copyright dispute in federal district court
- Represented one of the most well-known golf courses in the world in an unfair competition/false designation of origin dispute in federal district court
- Represented video game developers and publishers in a trademark and copyright infringement dispute involving an iconic space combat video game in federal district court
- Represented a payment processing technology company in a domain name dispute in federal district court
- Successfully represented trademark owners in Uniform Domain Dispute Resolution Policy (UDRP) cases
- Successfully defended against and settled claims of copyright infringement for multiple clients
Looking ahead
The importance of companies to protect and enforce their intellectual property rights globally will continue to increase as the digital marketplace and the free flow and access of information expands. Businesses should be creative and strategic when designing a tailored brand protection and enforcement program.
