/Overview
The traditional utility business model is undergoing tremendous change. An increasingly diverse power mix that includes utility-scale renewables and distributed generation, energy storage, and deregulation must contend with aging infrastructure and declining demand.
The keystone of this transformation is the Federal Energy Regulatory Commission’s (FERC) role in setting and influencing federal and state regulatory policies. Our practice spans the country—we monitor policies and regulations across the grid at-large, including those set by the regional transmission organizations (RTOs) and independent system operators (ISOs). Our strong Washington, DC, presence enables us to stay close to the activity that affects electric generation and electric and natural gas transmission facilities.
/Representative Experience
- Natural gas before state commissions and FERC
- Drafted natural gas supply, transportation, and storage arrangements in the United States and Canada
- Resolved compliance matters relating to FERC natural gas regulation, including capacity release and shipper must have title rules, assigning capacity (including in connection with portfolio sales and structuring transactions compliant with FERC rules)
- Defended clients during FERC enforcement proceedings
- Rate and certificate regulatory proceedings
- Electric regulatory work, including hydroelectric and transmission-related experience
- Various stakeholders before FERC in electric-related proceedings
- Hydropower licensing, re-licensing, preliminary permitting, and compliance issues
- Tracking and monitoring developments and trends affecting the hydro sector
- Participate in rulemakings for hydro organizations
- Frequently write and speak before legal audiences on hydro developments
- Various clients before a number of state public utilities commissions, including those in the New England states and California, New York, New Jersey, and Pennsylvania
- Represented clients before siting boards in California, New England, and New York in both natural gas and electric matters
